Is missed call text back legal in the UK?

Quick answer: Yes. In the UK, a missed call text back is legal when it is a neutral reply to someone who has just contacted you. It counts as a service message, not direct marketing, so the consent rules in PECR don't apply. It stops being safe the moment the text promotes anything, such as an offer or another service. UK GDPR still applies to the caller's number either way.

Why is missed call text back legal in the UK?

Two laws matter. PECR (the Privacy and Electronic Communications Regulations) restricts unsolicited direct marketing by text. UK GDPR controls how you handle personal data, including a phone number.

PECR defines direct marketing as advertising or marketing material directed at particular people. A text that says you missed their call and asks how you can help isn't advertising. It's a reply to someone who has just contacted your business.

The Information Commissioner's Office (ICO) calls messages like this service messages: informational, sent for customer service or admin, with nothing promotional in them. Its own example is a text confirming when an engineer will arrive. We couldn't find ICO guidance that names missed call text back specifically, so this applies its general rules to a newer tool.

When does a missed call text become illegal marketing?

When the content turns promotional. The ICO looks at the wording, tone and context of a message, and a message that is only partly promotional still counts as marketing. Adding "book this month for 10% off" to a missed call reply turns it into direct marketing.

Then the marketing rules apply. Consumers and sole traders are "individual subscribers", so you need their consent to text them marketing. The "soft opt-in" exception for people you've been dealing with requires that you offered an opt-out when you collected their details, which a missed call never gives you. Every marketing text must also identify your business and offer a way to opt out.

What does UK GDPR require for missed call text back?

A caller's phone number is personal data, so UK GDPR applies even when PECR doesn't. In practice:

What does a missed call cost a trade business?

Two surveys show how callers behave. Moneypenny's 2016 report on British builders found 69% of callers refuse to leave a voicemail. A j2 Global survey of UK consumers found 59% wouldn't leave a message on an unanswered call, and more than a third would ring the next business instead. Both are older studies, but the behaviour they describe is simple: callers who don't get an answer try the next trade.

The table below is our illustrative calculation, not survey data. It assumes 30% of missed calls are genuine new enquiries, a 35% close rate and £300 revenue per job. Replace these with your own figures.

Missed calls a monthGenuine enquiriesJobs lostRevenue lost a month
1031.0£315
2062.1£630
40124.2£1,260

What is the penalty for getting it wrong?

As of 2026, the maximum fine for PECR breaches is £17.5 million or 4% of global annual turnover, whichever is higher. It was £500,000 before the Data (Use and Access) Act 2025 came into force. The ICO says it reserves its largest fines for serious breaches and acts in a targeted way. A neutral one-off reply is low risk. A promotional one puts you inside the marketing rules.

What should a compliant missed call text say?

Acknowledge the call, ask one qualifying question and give a callback window:

Hi, it's [name] at [business]. Sorry we missed your call. What do you need help with, and what's your postcode? We'll call you back by [time].

The same template works across trades. A plumber might ask "What's the problem and is it urgent?", a roofer "Is it a leak or a planned job?", and a removals firm "Where are you moving from and to?". Keep it to one question and no promotion.

Our Lead Rescue automation is built on this rule: one neutral reply to each missed caller, with no promotional content.

Do I need consent to text someone who just called me?

Not for a neutral reply. A text that acknowledges the missed call and asks how you can help is a service message, so PECR's consent rules for marketing don't apply. UK GDPR still applies to the number.

Can I put a discount or offer in a missed call text?

No. Even a partly promotional message counts as direct marketing, so it would need consent and an opt-out. Keep the reply to acknowledging the call, asking a qualifying question and giving a callback time.

Does it matter that the text is automated?

No. The test looks at what the message says and why it is sent, not whether a person or software sent it. An automated neutral reply is still a service message.

Is missed call text back legal for plumbers and electricians?

Yes, on the same basis as any other business, provided the text is neutral and contains no offers. Name your business, ask one question and honour STOP requests.

What is the maximum fine for breaking PECR?

As of 2026 it is up to £17.5 million or 4% of global annual turnover, whichever is higher, up from £500,000. The ICO says it reserves its largest fines for serious breaches.
